Terms of Service

1. Acceptance of Terms

By accessing or using Sport99, operated by Inovitus 9 d.o.o., Slovenia, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all policies incorporated by reference. If you do not accept these terms in their entirety, you must immediately cease using the platform. These terms apply to club administrators, coaches, athletes, parents or guardians, and anyone accessing the platform on behalf of an organization.

2. Description of Service

Sport99 is a multi-tenant SaaS platform for sports club management, athlete performance tracking, AI-powered coaching intelligence, and administrative tools. Features include athlete management, training packages, attendance tracking, AI voice reports and transcription, benchmark comparisons, Intelligence Hub, wearable integrations, parent portals, billing, subscriptions, and multi-language support. Available features depend on your subscription plan.

3. User Accounts

You must provide accurate, current, and complete information during registration and keep it updated. Club administrators are responsible for managing their club users, roles, and permissions. Multi-factor authentication is mandatory and must be enabled within 30 days of account creation. Each user must have their own account with a unique valid email address. Notify security@sport99.ai immediately if you become aware of unauthorized account use.

4. Subscriptions & Billing

New club accounts receive a 14-day free trial with full feature access, subject to trial limits. After the trial, a paid subscription is required to continue creating and editing data. Billing is processed through Stripe. Invoices comply with Slovenian and EU VAT requirements, including VIES validation and reverse charge where applicable. Subscriptions renew automatically unless cancelled before the end of the current billing period.

5. Intellectual Property

Sport99, its logo, design system, AI workflows, benchmark databases, and platform code are the intellectual property of Inovitus 9 d.o.o. You retain ownership of all data you input into the platform. By using AI features, you grant Sport99 a limited license to process your content through Azure AI services solely to generate reports, insights, and analytics within the platform.

6. Data Processing

All data is stored in Microsoft Azure Sweden Central for GDPR compliance. Health data, injuries, medical notes, wearable biometrics, and mental wellness check-ins are processed only with explicit consent under GDPR Article 9. If consent is not given, health-related content is automatically redacted before AI processing. Multi-tenant Row-Level Security helps ensure tenant isolation.

7. No Medical, Psychological, or Nutritional Advice

SPORT99 IS NOT A HEALTHCARE PROVIDER, MEDICAL DEVICE, LICENSED PSYCHOLOGIST, PSYCHIATRIST, THERAPIST, NUTRITIONIST, DIETITIAN, OR OTHER LICENSED HEALTH PROFESSIONAL.

The platform and its AI outputs are provided for general informational and coaching support purposes only. They do not constitute medical advice, psychological counselling, nutritional prescriptions, physiotherapy guidance, or professional healthcare recommendations. Always consult a qualified professional before making health, safety, nutrition, or wellbeing decisions based on platform information.

8. AI Technology & Automated Processing

Sport99 uses artificial intelligence technology, including large language models and machine learning systems hosted on Microsoft Azure AI Foundry, to process voice recordings, generate training summaries, extract metrics, detect signals, compare benchmarks, and provide coaching insights. AI can make mistakes or generate incomplete information. All AI output must be reviewed by qualified humans before use or reliance.

9. Wearable Device Integration & Third-Party Data

Sport99 offers optional integrations with third-party wearable devices and health platforms such as Garmin, Fitbit, Apple Health, Google Fit, Whoop, Polar, Strava, and Suunto. These integrations are provided as a convenience. Wearable data may be delayed, incomplete, or inaccurate due to device limitations. Third-party integrations are subject to each provider’s terms.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SPORT99 IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. BUSINESS USERS ACCEPT THIS CONDITION; CONSUMERS RETAIN MANDATORY STATUTORY CONFORMITY AND REMEDY RIGHTS THAT CANNOT BE WAIVED BY CONTRACT.

For business (non-consumer) users, our total aggregate liability shall not exceed the greater of the amount paid by you in the 12 months preceding the claim or EUR 100. This cap does not apply to: (a) liability for death or personal injury caused by our negligence; (b) liability for fraud or fraudulent misrepresentation; (c) liability for intentional misconduct or gross negligence; (d) any liability that cannot be excluded or limited by applicable mandatory law. If you are a consumer under applicable law, your statutory rights (including rights arising from lack of conformity and mandatory consumer protection rules) are not affected by this section.

11. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Inovitus 9 d.o.o., its officers, employees, partners, and licensors from claims arising from your use or misuse of the platform, violation of these Terms, unlawful conduct, uploaded content, reliance on AI-generated content without professional verification, or injury related to training activities.

12. Termination

Either party may terminate this agreement at any time. Upon cancellation, your subscription continues until the end of the current billing period. After termination, data is retained for a 30-day reactivation window before soft-deletion. You may request a data export before deletion. We may suspend or terminate accounts that violate these terms or applicable law.

13. Force Majeure

Inovitus 9 d.o.o. is not liable for delay or failure to perform caused by events outside its reasonable control, including natural disasters, war, terrorism, civil unrest, government action, sanctions, strikes, outages, cyberattacks, third-party cloud failures, fire, floods, or shortages.

14. Changes to Terms

We may modify these terms by posting the revised version on the platform. Material changes will be communicated by email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance of the modified terms.

15. Governing Law & Dispute Resolution

These terms are governed by the laws of the Republic of Slovenia. For business users, disputes are subject to the exclusive jurisdiction of the competent courts in Ljubljana, Slovenia. If you are a consumer under applicable law, you retain the right to bring proceedings before the courts of your country of residence under mandatory consumer-protection rules; the Ljubljana forum applies only to the extent permitted by mandatory law. EU consumers may also use the European Commission Online Dispute Resolution platform at ec.europa.eu/consumers/odr. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

16. Severability & Entire Agreement

If any provision is held invalid or unenforceable, the remaining provisions continue in full force. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Inovitus 9 d.o.o. regarding Sport99.

17. Governing Language

These Terms are published in multiple languages as a convenience. The English version is the controlling version. In the event of any inconsistency or conflict between a translation and the English version, the English version prevails.

18. Statutory Consumer Rights & Withdrawal

If you are a consumer in the European Union purchasing a paid subscription, you have a statutory right to withdraw from the contract within 14 days of the start of your subscription without giving any reason (the 'cooling-off period'), unless you have expressly requested that the service begin during this period and acknowledged that the right of withdrawal is thereby lost. To exercise the right of withdrawal, contact legal@sport99.ai within 14 days. Nothing in these Terms affects your rights under applicable mandatory consumer-protection law.
